Representative Matters
- Obtained an order of dismissal along with John Hall for the Penn National Gaming Company on an interlocutory appeal to the Mississippi Supreme Court. The matter, pending in the Hinds County Circuit Court, involved a wrongful death "dram shop" action against Penn National, and its subsidiary Casino operator, Casino Magic, Bay St. Louis. The Supreme Court held that the Casino operator's retail alcohol permit could not be attributed to the operator's parent company, and thus Penn National was not liable under Mississippi's dram shop law, which only created liability for the permit holder and the employees of the permit holder.
