In an action alleging medical malpratice, Circuit Court Judge Kitchens found the plaintiff failed to provide testimony on the "essential element of causation." The Court properly found that it is not enough in a medical malpractice case to offer an expert witness on the standard of care but the expert must establish causation which requires the plaintiff to show "'proper treatment would have provided the patient with a greater than fifty (50) percent chance of a better result than was in fact obtained.'" No such showing was presented by the plaintiff.
