Kaufman, Jones and Fontan Win Summary Judgment

David Kaufman, Trey Jones, and Chris Fontan obtained summary judgment for Tyson Farms, Inc. in the United States Disctrict Court for the Southern District of Mississippi. The action was brought by a former grower who alleged breach of contract through early termination.  District Court Judge Carlton Reeves entered summary judgment in favor of Tyson against the former grower who had used abusive language and threatened Tyson's chicken catching crew, finding that the grower's chicken growing contract clearly and unambiguously permitted the termination for this conduct directed at Tyson's representative.
