Jeannie Sansing Wins Summary Judgment in Torts Claim Act Action

Jeannie Sansing, defending several university professors, won summary judgment in a wrongful termination action covered by the Tort Claims Act.  The Oktibbeha County Circuit Court Judge ruled that suit was barred by the one year statute of limitations applicable to actions brought under the Torts Claim Act.  The one year statute began to run on the date the plaintiff received her notice of termination.  After applying the tolling provisions [for purposes of providing notice to the state entity and for investigating the claim], the Court held the action was filed outside the statutorily allotted time. The Circuit Court Judge also found that the plaintiff failed to come forward with facts to support application of the extraordinary remedy of equitable estoppel.
