On November 2, 2011, Judge Ellen Segal Huvelle of the United States District Court for the District of Columbia entered an opinion allowing C Spire Wireless to proceed with its antitrust lawsuit seeking to enjoin the merger of AT&T and T Mobile. [Decision] AT&T had sought dismissal of the lawsuit on the grounds that as a competitor of AT&T, C Spire had no grounds to sue. The Court disagreed with AT&T, holding that C Spire did have standing to sue because of the potential adverse effect of the proposed transaction on the availability of wireless devices and roaming.
