Court Allows C Spire Action to Enjoin AT&T-T Mobile Merger to Proceed

On November 2, 2011, Judge Ellen Segal Huvelle of the United States District Court for the District of Columbia entered an opinion allowing C Spire Wireless to proceed with its antitrust lawsuit seeking to enjoin the merger of AT&T and T Mobile. [Decision] AT&T had sought dismissal of the lawsuit on the grounds that as a competitor of AT&T, C Spire had no grounds to sue.  The Court disagreed with AT&T, holding that C Spire did have standing to sue because of the potential adverse effect of the proposed transaction on the availability of wireless devices and roaming.  Brunini attorneys Chuck McBride, Joseph Sclafani and Brian Kimball serve as co-counsel on the legal team representing C Spire Wireless in the matter.
