Congratulations on Federal Court Win to Matt Allen

Congratulations to Matt Allen and clients Virginia College and Education Corporation of America for obtaining an order dismissing plaintiff's individual federal claims, class action claims, and compelling to arbitration all state law claims in Daniels v. Virginia College at Jackson, Virginia College, LLC, and Education Corporation of America in the United States District Court for the Southern District of Mississippi. [Opinion] United States District Judge Barbour noted that the motion to dismiss the plaintiff’s federal claims under the Higher Education Act and/or Higher Education Opportunity Act, based on lack of private cause of action, was unopposed and should be dismissed. With respect to the state claims of alleged misrepresentation, unjust enrichment and conversion, the Court found that those claims were required to be arbitrated pursuant to the enrollment and tuition agreement.  The Court additionally found the plaintiff's class action claims were moot and should be dismissed.  Thus, the Court ordered arbitration and dismissed the case.
