Jury Verdict Reversed and Rendered in Favor of Trustmark National Bank

On December 8, 2011, the Mississippi Supreme Court reversed a jury verdict and rendered judgment in favor of Brunini's client, Trustmark National Bank.  Roxco, Ltd. was a general construction contractor on several projects for the State of Mississippi.  Roxco utilized the state statute that allows contractors to pledge securities in lieu of the retainage on the contract, and the securities were held at Trustmark.  Following Roxco's default on several projects, the State of Mississippi requested that Trustmark turn the securities over to the State.  Roxco objected, but Trustmark turned the securities over to the State.  Roxco filed suit against Trustmark alleging various torts and breach of contract.   The Hinds County Circuit Judge denied Trustmark's request that the case be dismissed, and a jury awarded Roxco $3,720,000.  Trustmark appealed.  The Mississippi Supreme Court concluded that Trustmark's actions were consistent with state law and that the undisputed trial evidence did not warrant a recovery by Roxco.  The Supreme Court reversed the jury verdict and rendered judgment for Trustmark.
