Wade, Werne and Staines Retain Directed Verdict

The Mississippi Supreme Court reinstated a directed verdict in favor of hospital client.  The trial court had granted the directed verdict finding the plaintiff failed to provide sufficient evidence of causation of injury related to an alleged fall. The Supreme Court granted certiorari after the Court of Appeals remanded for a new trial. The Supreme Court found that a medical expert must testify in terms of probabilities not possibilities.  Opinion
