Environmental Law

The Firm’s environmental practice group is acknowledged as a statewide leader. Our attorneys have broad experience in both environmental litigation and regulatory proceedings and have defended numerous enforcement actions instituted by the United States Department of Justice, Region IV of the Environmental Protection Agency, and the Mississippi Commission on Environmental Quality, including actions brought under TSCA, RCRA, CERCLA, the Clean Water Act, the Clean Air Act, the Mississippi Air and Water Pollution Control Law, the Mississippi Solid and Hazardous Waste Law, and the Mississippi Underground Storage Tank Act. The firm has also obtained numerous environmental permits for its clients in proceedings before the Mississippi Environmental Quality Permit Board and the U.S. Army Corps of Engineers.

Natural Gas Storage and Transportation

The Brunini Firm’s energy law practice has been recognized as a regional leader for decades. The Firm’s natural gas practice includes the representation of pipelines, local distribution companies, marketers, and storage operators. The Firm’s pipeline representation includes many of the interstate natural gas pipelines in Mississippi, as well as oil, product and intrastate gas lines and a major local natural gas distribution company. The Firm’s attorneys handle all aspects of these clients’ work in Mississippi and have been engaged as lead counsel on their behalf in matters in other states. In addition to handling contract and regulatory issues, the Firm’s trial lawyers have litigated major natural gas curtailment, take or pay, and royalty cases.

The Firm also represents natural gas marketers in all aspects of their Mississippi operations.  The Firm has been actively involved in the development of underground natural gas storage facilities in both deflated gas fields as well as gas and liquids in caverns created by solution mining in salt domes.  Brunini’s representation has included preparation of gas storage agreements, title examination needed for the development of storage facilities, acquisition of necessary easements for pipelines and interconnects (including condemnation actions, as needed), acquisition of necessary permits from regulatory agencies, regulatory approval of implementation and operation of gas storage facilities and litigation associated with these activities.

Oil, Gas, and Coal Exploration and Production

The Firm’s exploration and production work constitutes an important component of its energy practice. This work includes representation of major oil companies and independent producers in all phases of the development of oil, natural gas, and coal reserves in Mississippi, including practice before the Mississippi Oil and Gas Board. The Firm’s services include title examination, negotiating leases, contracts and transactions, obtaining permits, and advising on other regulatory requirements. Attorneys practicing in this area also maintain a significant litigation practice in conjunction with the Firm’s trial attorneys. The Firm has handled title, contract, drainage, balancing and gas processing disputes, as well as lawsuits relating to well damage, blow-outs, and NORM, benzene and other oil field contamination issues.

Public Utilities

The Firm practices frequently before the Mississippi Public Service Commission, representing one of the largest gas utilities, as well as, a number of intrastate and interstate pipeline companies, telecommunication companies, and water and sewer companies. The Firm is Mississippi counsel for the only electric regional transmission organization in Mississippi. Brunini attorneys have served as counsel in administrative proceedings and litigation regarding rates and service and application for certificates of public convenience and necessity for the construction of electric generation facilities, natural gas transmission and distribution facilities, and underground natural gas storage facilities.

Healthcare

Telecommunications

The Brunini Firm serves as regular counsel to the largest privately held wireless carrier in the United States.  The Firm represents and counsels a number of telecommunications companies in business, litigation, and federal and state regulatory matters. The Firm represents its telecommunications clients in wireless license acquisitions and exchanges, mergers and acquisitions, asset sales and purchases, secured transactions, financing, antitrust, and warranty issues. The Firm also regularly prepares, negotiates and reviews contracts for its clients in the telecommunications industry, including contracts relating to interconnection, equipment purchases, networks, sales of capacity, software licenses, intellectual property, and service agreements.  The Firm represents its telecommunications clients in litigation in federal and state courts and in contested proceedings before the Mississippi Public Service Commission. These disputes involve issues that are unique to the telecommunications industry, such as federal and state telecommunications laws and regulations, interconnection, access charges and universal service, as well as other commercial disputes. The Firm’s attorneys represent clients in telecommunications franchise and zoning matters before local governmental bodies and in litigation under the Federal Telecommunications Act of 1996. The Firm also assists in obtaining Certificates of Public Convenience and Necessity in proceedings before the Mississippi Public Service Commission and it provides right-of-way acquisition services for fiber optic cable projects. The Firm advises clients on federal and state policy matters including strategy development and implementation. The Firm’s telecommunications clients provide wireless services, including PCS and broadband, fiber optic telecommunications and information services, Internet access, and long distance and competitive local exchange service throughout the United States.
